Definitions

Controller – means 9d Sp. z o.o., with its registered office in Warsaw (04-776), ul. Motylkowa 65B, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register under KRS number 0000336526, with a share capital of PLN 25,000 fully paid up, NIP 9522076515, REGON 142005020, tel. +48 22 113 99 99, e-mail: daneosobowe@9design.pl, which provides electronic services and stores and accesses information on the User’s device.

Personal Data – all information relating to an identified or identifiable natural person by one or more specific factors determining the physical, physiological, genetic, mental, economic, cultural or social identity of a natural person, including the device IP number, location data, internet identifier, and information collected through cookies and other similar technologies.

Online Store / Store – means the website or application through which the Controller conducts online sales, operating under the domain 9design.pl.

User – a natural person visiting the Store.

Customer – a natural person who has concluded a written sales agreement with the Controller.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 7 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

Account – a space available to the User within the Store where the User enters, manages and publishes their data according to selected privacy settings. The Account includes the Customer’s transaction history and loyalty programme points balance.

I. INTRODUCTION TO THE PRIVACY POLICY

The Controller uses the User’s Personal Data because the User decided to make purchases in the Controller’s Store or consented to receive commercial information electronically to the provided e-mail address regarding the Store’s offer, or otherwise provided the Controller with their data through the Store’s website.

The Store operates on the basis of the Terms and Conditions available here.

II. PURPOSES AND LEGAL BASES FOR DATA PROCESSING IN THE STORE

1. Performance of the agreement

For the purpose of performing sales agreements concluded with the User for goods purchased from the Store, the legal basis for processing the User’s Personal Data shall be the agreement concluded with the Controller through acceptance of the Store Terms and Conditions.

2. Defence and enforcement of claims and other legal obligations

The Controller processes the User’s and Customer’s Personal Data in order to fulfil legal obligations imposed on it, detect and prevent abuse, establish, defend and pursue claims.

3. Use of the Store

The Controller processes the Personal Data of Users using the Store, including IP addresses, identifiers and data collected through cookies.

  • marketing activities of the Controller.

4. Use of the Account

The Controller processes the User’s Personal Data for the purpose of maintaining the Account on the Store website.

Registration of an Account requires providing data such as name, surname, e-mail address, telephone number and postal address.

5. Complaint procedure

The Controller processes the Customer’s Personal Data for the purpose of handling complaint procedures.

6. Contact forms

The Controller provides the possibility to contact it using electronic contact forms.

7. Personalisation and content adjustment in the Store

The Controller processes Personal Data in order to personalise content and adjust Store functionalities to Users’ needs.

III. MARKETING

The Controller processes the User’s Personal Data for marketing activities.

Persons who provide their e-mail address may receive the Newsletter service.

IV. SOCIAL MEDIA STORES

The Controller processes Personal Data of Users visiting social media accounts operated by the Controller on Facebook, Instagram, YouTube, LinkedIn, Pinterest and TikTok.

V. COOKIES

The Online Store uses cookies for:

  • handling forms,
  • saving User preferences,
  • statistical analysis,
  • ensuring website security.

The Online Store uses session cookies and persistent cookies.

VI. DATA RECIPIENTS

User data may be transferred to service providers cooperating with the Controller.

  • right to lodge a complaint with the President of the Personal Data Protection Office.

VIII. PERSONAL DATA RETENTION PERIOD

  1. Personal Data shall be stored for the period necessary to perform the sales agreement.
  2. Data may continue to be processed after account deletion for the purpose of pursuing claims.
  3. Data related to loyalty discounts may be processed indefinitely.
  4. Accounting data shall be stored in accordance with applicable legal regulations.
  5. Data provided through forms shall be processed until consent is withdrawn.

IX. PERSONAL DATA SECURITY

The Controller regularly analyses risks and applies appropriate security measures to protect Users’ Personal Data.

X. PRESIDENT OF THE PERSONAL DATA PROTECTION OFFICE

A data subject has the right to lodge a complaint with the President of the Personal Data Protection Office.

XI. VALIDITY OF THE POLICY

The Privacy Policy is subject to ongoing verification and updates. Each version of the Policy contains the date from which it becomes effective.
